留学生注意！秋学期がオンライン授業のみの場合、米国滞在不可です

アメリカの多くの大学でオンラインによる授業・学位を提供していますが、もともとアメリカ国外の学生はこの過程に入学しようとも学生ビザであるF-1が発効されず、結果入学は認められてきませんでした。逆に対面式の授業に出席する場合は語学学校も含めてほぼ問題なくF-1が出され、アメリカ入国・滞在が許されてきました。ところが移民・関税執行局（通称ICE）が今日発表した話によると、すでにアメリカに入国し大学・大学院に在籍していても新型コロナウイルス流行のために秋学期が全てオンラインに移行された場合、滞在が認められない、ということです。

SEVP modifies temporary exemptions for nonimmigrant students taking online courses during fall 2020 semester

オンキャンパス以外働く権利もなく、学費や滞在費を払ってアメリカにいる留学生はアメリカにとって大顧客のはずですが、前例と照らし合わせたのか、同様な処置を決定したようです。

以下簡単に内容を紹介します。

Nonimmigrant F-1 and M-1 students attending schools operating entirely online may not take a full online course load and remain in the United States. The U.S. Department of State will not issue visas to students enrolled in schools and/or programs that are fully online for the fall semester nor will U.S. Customs and Border Protection permit these students to enter the United States. Active students currently in the United States enrolled in such programs must depart the country or take other measures, such as transferring to a school with in-person instruction to remain in lawful status. If not, they may face immigration consequences including, but not limited to, the initiation of removal proceedings.

（非移民のF-1およびM-1の学生は、オンラインだけで全ての授業を取ることは許されず、米国に留まることも出来ない。米国国務省は秋学期に完全にオンラインである学校やプログラムに入学する学生に対しビザを発行しない。また米国税関・国境保護局は、これらの学生が米国に入国することも許可しない。現在米国に滞在しそのようなプログラムに在籍している学生はアメリカから出るか、または合法的に学生ビザを維持するために対面授業のある学校に転校するなどのその他の措置をとる必要がある。対応しない場合、強制退去などの処遇に直面する可能性がある）

Nonimmigrant F-1 students attending schools operating under normal in-person classes are bound by existing federal regulations. Eligible F students may take a maximum of one class or three credit hours online.

（通常の対面授業で運営される学校に通う非移民F-1学生は、既存の規制に縛られる。対象となるFビザの学生は、最大で1クラスまたは3単位までオンラインで受講可である。）

Nonimmigrant F-1 students attending schools adopting a hybrid model—that is, a mixture of online and in person classes—will be allowed to take more than one class or three credit hours online. These schools must certify to SEVP, through the Form I-20, “Certificate of Eligibility for Nonimmigrant Student Status,” certifying that the program is not entirely online, that the student is not taking an entirely online course load this semester, and that the student is taking the minimum number of online classes required to make normal progress in their degree program. The above exemptions do not apply to F-1 students in English language training programs or M-1 students pursing vocational degrees, who are not permitted to enroll in any online courses.

（ハイブリッドモデル、つまりオンラインと対面を併用する授業を提供する学校に通う非移民F-1学生は、1クラス以上もしくは3単位以上の授業を取ることが可能である。これらの学校は、プログラムが完全にオンラインでないこと、学生が全てオンラインで授業を取っていないこと、そして学位取得に向けて必要最低限のオンライン授業しか受講していないことを（大学側が）I-20を通じてSEVPに認定される必要がある。上記の免除は、オンラインコースへの登録が許可されない英語トレーニングプログラムのF-1学生（英語学校）もしくは職業学位を取得するM-1学生には適用されない。）

Nonimmigrant students within the United States are not permitted to take a full course of study through online classes. If students find themselves in this situation, they must leave the country or take alternative steps to maintain their nonimmigrant status such as a reduced course load or appropriate medical leave.

（米国内に滞在する非移民の学生は、全ての授業をオンラインのみで取ることは出来ない。学生がこの状況に陥った場合、米国を離れるか、授業負荷を軽減するか、病気を理由にして休みを取るなど、非移民ステータスを維持するために代替措置を講じる必要がある。）

正直最後の文章の意味が不明です。卒業前の最後の学期以外、留学生はフルタイム（通常学部生12単位、大学院生9単位）の学生でいることを強いられ、受講単位を減らすことは許可されないはずです。また病気でもないのに病気休暇を取れば？という説明も理解不能です。ちなみに正規留学の場合F-1は日本人の場合5年発効されますが、確か2セメスター欠席してしまうと取り直しとなるはずです。ビザ再取得にはお金もかかるし手間もかかりますが、この制度は現在の状況によるものでも維持されるのでしょうか？

Due to COVID-19, SEVP instituted a temporary exemption regarding online courses for the spring and summer semesters. This policy permitted nonimmigrant students to take more online courses than normally permitted by federal regulation to maintain their nonimmigrant status during the COVID-19 emergency.

（COVID-19蔓延のためSEVPは春と夏学期のオンラインコースに関する一時的な免除を設けた。このポリシーにより非移民の学生はCOVID-19緊急時での非移民ステータス維持のために、通常許可される授業数よりも多くのオンライン授業を受講出来ていた。）

つまり秋学期は通常運営に戻し、この特別な許可維持しないよ、ということでしょう。しかし経済を優先するはずの現政府が、お客さんである留学生までこのような扱いをするとは驚きました。留学生である皆さんは自分の大学の留学生オフィスにすぐ確認をし、受講予定の授業がオンラインでないことを確認することを強くお勧めします。例えばハーバード大学ですが、以下の記事によると秋に大学に戻れるのは1年生と3年生のみなので、2年生と4年生の留学生は母国に原則帰国しないといけなくなります。

一方で以下の質問には移民局担当者が答えに窮してました。

"The bigger issue is some of these countries have travel restrictions on and they can't go home, so what do they do then?"

（より大きな問題は、いくつか国には渡航制限がありその国出身の学生は家に帰れません。そんな彼らはどうすればいいですか？）

"It's a conundrum for a lot of students."

（それは多くの学生に対する難しい問題です）

英語で「良い質問だ」とか「難しい問題だ」というのは答えがないときの返答ですから、対応策が今のところないようです。どちらにせよ、F-1ビザで米国滞在されている方は今後の状況・情報に十分にご注意下さい。
